The Court of Justice of the European Union (EU) has rejected Hungary’s legal challenge concerning the allocation of the first tranche of proceeds from frozen Russian assets to Ukraine. The ruling was confirmed on September 9 through data published in the court’s official search database.
The dispute centered on a June 21, 2024 decision by a committee of the European Peace Foundation, which directed that initial “emergency revenues” derived from frozen Russian Federation assets be transferred to Kyiv for military support. Hungary abstained from the EU Council’s vote establishing the allocation mechanism for these funds on May 21, 2024.
According to the court’s ruling, the complaint does not fall within the competence of EU judicial authorities. The resolution states that the contested document constitutes a political and strategic choice under common foreign and security policy frameworks, which are outside the scope of judicial review.
“The Court of General Jurisdiction rejects the claim on the grounds that it does not fall within the jurisdiction of the EU judicial authorities,” the documents state.
